REAL ESTATE PRACTICE
Our Real Estate Practice Group is one of the firm's largest and most experienced practice areas. Attorneys in the Real Estate Practice Group represent a diverse group of individuals and corporations through all aspects of real estate-related transactions. Our projects range in size from single-tract transactions to multi-use developments and planned communities. Projects include office buildings, apartment complexes, rehabilitation housing, residential subdivisions, ranch, dairy and farm sales, restaurants, golf courses, hotels, shopping centers, and industrial parks. Our group handles projects throughout the State of Arizona, and in other states across the nation. Because of the depth of the firm's practice, our real estate clients are able to draw upon experience in nearly every area of the law.
The scope of practice in the Real Estate Practice Group includes the following types of matters:
- Purchase, finance and sale of real property, including entity formation to acquire and develop property, real estate loans, refinancing and workouts, real estate syndications and private placements, title insurance and survey matters, easements, land use planning, condemnation issues, and state and federal income tax matters related to real estate transactions. In this area, our attorneys have handled the purchase and sale of some of the largest office buildings, industrial parks, ranches and apartment complexes throughout the State.
- Purchase and sale of resorts and hotels, including acquisition and construction financing, construction contracts, management and operation agreements and liquor license issues.
- Extensive title and survey reviews and negotiation with title companies regarding title policy requirements and issuance.
- Drafting of CC&R's for commercial and residential developments, reciprocal use agreements for common use areas, and incorporation of homeowner associations.
- Purchase and sale of ranches, dairies and farms, BLM and Forest Service grazing permits, irrigation issues, wells and water rights and State of Arizona crop and grazing leases.
- Lease preparation and negotiation for office and commercial complexes, representing both landlord and tenant.
- Financing transactions.
- Acquisition and assemblage of land for development.
- Representation before the Arizona Department of Real Estate, including preparation of public reports and related governmental filings.
- Preparation of development agreements and joint ventures for the acquisition and development of projects.
- Preparation and negotiation of construction contracts and related matters.
- Mechanic's and materialman's liens preparation, filing and litigation.
